The defendant Freda W. Kaiser commenced a suit in the circuit court of Barron county to quiet title to certain real estate
            against the plaintiff Robert K. Ochiltree and lien claimants. Upon Ochiltree's default, judgment was entered against him.
            Shortly thereafter Ochiltree started this action in the county court of Barron county for specific performance of two alleged
            contracts involving the real estate. Upon his application the judgment in the quiet title action in the circuit court was
            set aside and the action consolidated with this action which was transferred to the circuit court. In the suit for specific
            performance of the contracts Mrs. Kaiser answered and counterclaimed to quiet title. The case was tried by the court and resulted
            in judgment on the counterclaim. Not involved in this appeal is the Disposition of the lien claims which the court allowed
            against the property. After the entry of judgment and the retirement of Judge Daley, Ochiltree applied to the circuit court
            to vacate the judgment. His motion was denied by Judge Allen Kinney who succeeded Judge Daley as Circuit Judge. From the judgment
            and the order, Ochiltree appeals. HALLOWS, Justice.
